Terms of Service
The agreement that governs access to and use of the ejumah marketplace.
Effective date: [●]
1. Agreement
These Terms of Service govern access to and use of Ejumah's website, Android application, dashboards and marketplace services. By creating an account, clicking acceptance, posting or accepting a job, sending or accepting a quote, making a payment or otherwise using Ejumah, you agree to these Terms and the policies that apply to your role.
If you use Ejumah for a company, you confirm that you have authority to bind that company.
2. Platform role
Ejumah operates a technology marketplace that enables customers to find and engage independent workers and service companies. Unless Ejumah expressly agrees otherwise in writing:
- Ejumah is not the worker, contractor, employer, agent or guarantor of a user;
- workers and companies decide whether to quote for a job;
- customers decide which quote to accept;
- the service contract is formed between the customer and the selected worker or company;
- the selected worker or company is responsible for the workmanship, personnel, tools, licences, safety and delivery of the service; and
- Ejumah may provide marketplace protection, payment instructions, evidence tools, support and dispute facilitation without becoming the service provider.
Nothing in these Terms excludes a responsibility that Ghanaian law does not allow us to exclude.
3. Eligibility and accounts
You must:
- be at least 18 years old;
- provide accurate and current information;
- use your own identity and contact details;
- keep credentials and verification codes confidential;
- promptly update changed information; and
- comply with verification requests.
One person may not create duplicate or misleading accounts. You are responsible for activity carried out through your account unless you promptly report compromise and the activity was not caused by your failure to protect the account.
4. Verification
Ejumah may require identity, business, address, qualification, liveness or other verification. Verification means only that specified checks were completed at a particular time. It is not a guarantee of character, competence, safety, solvency or future conduct.
Ejumah may approve, reject, repeat or refer verification for manual review. Technical capture failures should not by themselves be treated as fraud, but repeated rejected or suspicious submissions may result in account review.
5. Jobs and quotations
Customers must describe jobs honestly and provide information reasonably necessary for a worker to assess the work.
Quotes are estimates unless explicitly marked as fixed and permitted by the platform. A quote may include:
- estimated labour;
- estimated parts or materials;
- an inspection requirement;
- an inspection fee;
- expected duration;
- conditions and exclusions; and
- a validity period.
A quote does not authorise extra work or charges beyond the accepted amount. Changes must be submitted through Ejumah and approved by the customer before the additional work or cost is incurred, except where immediate action is reasonably necessary to prevent danger or serious property damage and the law permits it.
6. Inspection fees
Where an inspection is required, the applicable inspection fee will be displayed before acceptance. Current platform rules may calculate an inspection fee based on distance, including GHS 50 for each five kilometres or part thereof, subject to the amount shown in the checkout flow.
Inspection fees compensate attendance and assessment and may be non-refundable once the worker has travelled or completed the inspection, except where the worker fails to attend, the charge was incorrect, or Ejumah determines that a refund is appropriate.
If a customer seeks a second opinion, a new inspection fee may apply. Any Ejumah-funded discount will be shown before confirmation.
7. Payments and protected release
Payments are processed through approved third-party payment providers. Unless Ejumah has obtained all required regulatory authorisations, Ejumah does not operate as a bank, deposit-taking institution or independent escrow company.
When a customer accepts a quote, the payment provider may authorise, collect, reserve or otherwise safeguard the amount according to its rules. Ejumah records the transaction in its internal marketplace ledger and sends release, refund or payout instructions when the applicable conditions are met.
A displayed "held", "protected", "escrow" or similar status means that the platform has recorded the amount as unavailable for ordinary withdrawal pending completion, cancellation, refund or dispute resolution. It does not mean that Ejumah accepts deposits or guarantees payment-provider performance.
Fees, payment-provider charges and applicable taxes will be disclosed before confirmation where required.
8. Job progress and completion
The selected worker or company may be required to:
- acknowledge the assignment;
- confirm that they are en route;
- verify arrival using GPS or a customer PIN;
- upload before-work evidence;
- record approved changes;
- upload after-work evidence; and
- request completion.
The customer should inspect the work and either approve completion or raise a specific issue within the displayed review period.
If the customer does not respond, Ejumah may send reminders and may release payment after the stated escalation period if the available records indicate completion and no dispute has been opened. The exact review and auto-release period must be displayed in the job flow and confirmation notice.
9. Cancellations
Cancellation consequences depend on the job stage, travel, inspection, work performed, materials purchased and the reason for cancellation.
The cancellation screen will show any applicable charge or refund before confirmation where practicable. Ejumah may apply its cancellation matrix, including:
- full refund before acceptance or payment, less any non-refundable provider charge where legally permitted;
- deduction of an earned inspection or call-out fee after travel or attendance;
- payment for authorised work already performed or non-returnable approved materials;
- penalties or account review for repeated abusive cancellations; and
- delayed refunds, generally five to ten business days, where banking or payment-provider processing is required.
Users must not cancel in order to complete the same transaction outside Ejumah. Suspected off-platform circumvention may lead to delayed review, loss of marketplace protection, fees, suspension or termination.
10. Disputes
A user should open a dispute through Ejumah promptly and provide relevant evidence. Ejumah may:
- pause release or payout where technically and legally possible;
- request messages, quotations, receipts, photographs, video, location data or professional reports;
- permit a response from the other party;
- recommend correction, partial payment, refund, re-performance or another resolution;
- make a platform decision for purposes of allocating marketplace funds; or
- refer the parties to an external authority or dispute process.
Ejumah's internal decision is a marketplace-administration decision and does not prevent either party from pursuing rights available under Ghanaian law, unless a lawful settlement states otherwise.
11. Wallets and withdrawals
A wallet balance is an internal ledger showing amounts potentially payable through the marketplace. It is not a bank account, savings product or stored-value facility unless expressly provided through an appropriately licensed partner.
Amounts may be marked pending, available, reserved, reversed, refunded or disputed. Ejumah may delay or restrict withdrawal where required for:
- refunds, chargebacks or reversals;
- an active warranty or dispute;
- suspected fraud or account compromise;
- identity, tax or regulatory review;
- negative balance recovery; or
- payment-provider processing.
12. Reviews and trust indicators
Reviews must be based on genuine Ejumah transactions and must not be abusive, discriminatory, deceptive or manipulated. Ejumah may remove or restrict reviews that violate policy.
Trust scores, completion rates, arrival times and quotation-accuracy indicators are informational marketplace metrics. They are not guarantees.
13. Communications
Users must use Ejumah's chat and approved contact tools for material job communications. Messages may be retained and reviewed for safety, support, disputes and enforcement.
14. Prohibited conduct
You must comply with the Acceptable Use Policy. Prohibited conduct includes fraud, impersonation, unsafe work, unlawful services, harassment, payment circumvention, review manipulation, misuse of personal data, unauthorised account access and attempts to interfere with the platform.
15. Suspension and termination
Ejumah may restrict, suspend or terminate an account where reasonably necessary to protect users, comply with law, investigate misconduct, manage non-payment or enforce these Terms.
Where appropriate, we may provide notice and an opportunity to respond. Immediate restriction may occur for fraud, safety, security, identity or legal risks.
Termination does not remove obligations relating to completed transactions, outstanding payments, disputes, confidentiality, data retention or liability.
16. Intellectual property
Ejumah and its licensors own the platform, software, branding and platform content. Users receive a limited, revocable, non-transferable right to use the service for its intended purpose.
Users retain ownership of content they upload but grant Ejumah a worldwide, non-exclusive licence to host, copy, process, display and use that content as reasonably necessary to operate, secure and promote the marketplace. Promotional use of identifiable job content should require additional permission where appropriate.
17. Availability and changes
We do not guarantee uninterrupted or error-free access. We may modify, suspend or discontinue features and may require an app update for security or compatibility.
18. Disclaimers and liability
To the extent permitted by law:
- Ejumah does not guarantee that a user will receive quotes, win jobs, complete jobs or earn a particular amount;
- Ejumah does not guarantee the quality, safety or legality of services supplied by independent users;
- users remain responsible for insurance, licences, professional judgment and safe conduct; and
- Ejumah is not liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable.
Any liability cap must be reviewed by Ghana counsel and must not exclude liability that cannot lawfully be limited, including liability arising from fraud, wilful misconduct or legally protected consumer rights.
19. Indemnity
To the extent permitted by law, a business user, worker or company will be responsible for losses, claims, penalties and reasonable costs arising from that user's unlawful conduct, breach of these Terms, infringement of another person's rights, or unsafe or defective service, except to the extent caused by Ejumah's own breach or negligence.
20. Governing law and complaints
These Terms are governed by the laws of Ghana. Users should first submit complaints through Ejumah support. The parties may attempt good-faith negotiation or mediation before litigation, but nothing prevents a consumer from using a court, regulator or remedy available under Ghanaian law.
21. Electronic contracting
You agree that contracts, notices, acceptances, receipts and records may be provided electronically and retained in a form capable of later reference. Before confirming a transaction, the platform should allow you to review the material terms and correct input errors.
22. Changes to these Terms
We may update these Terms. Material changes will be notified through the platform or by email. Changes will apply prospectively unless law requires otherwise.
